These terms and conditions (the “Terms”) govern the use of pilates.org.au (the “Site”) which is owned and operated by the Pilates Association Australia (the “PAA”).

By using this Site. you indicate that you have read and understand these Terms and agree to comply with them. These Terms apply to all visitors, users and others who access or use the Site.

You represent that you are over the age of 15. The PAA does not permit those under 15 to use the Site.

Privacy and Data Protection

Your access to, and use of, the Site is conditioned on your acceptance of, and compliance with, the Privacy Policy of the PAA. Our Privacy Policy describes our policies and procedures on the collection, use and disclosure of your personal information when you use the Site and tells you about your privacy rights and how the law protects you. Please read our Privacy Policy carefully before using the Site.

 

Intellectual Property

The Site, its original content (excluding content provided by you or other users), its features and functionality are, and will remain, the exclusive property of the PAA. This includes but is not limited to, images, text, logos, documents, downloadable files, domain names and anything that contributes to the composition of the Site.

Our intellectual property must not be copied, used, displayed, reproduced or redistributed without the prior written consent of the PAA.

 

User Obligations

By using this Site, you agree not to:

  • Use the Site in connection with any commercial endeavours except those that are specifically endorsed or approved by the PAA
  • Use the Site for unlawful purposes
  • Send unsolicited electronic messages via the Site
  • Trick, defraud, or mislead the PAA and other users, especially in any attempt to learn sensitive account information such as user passwords
  • Circumvent, disable, or otherwise interfere with security-related features of the Site
  • Use any information obtained from the Site to harass, abuse, or harm another person
  • Make improper use of our support services or submit false reports of abuse or misconduct
  • Upload or transmit viruses, or other material, that interferes with uninterrupted use or enjoyment of the Site

 

User Accounts

When you create an account with us, you agree to the following:

  • All personal information you provide is, to the best of your knowledge, accurate, complete, and current
  • You will update any changes to your personal information on the Site as quickly as possible
  • You are responsible for safeguarding the password that you use to access the account and are responsible for any actions carried out under your password
  • You will not disclose your password to any third party and will notify us immediately if you become aware of any breach of security or unauthorised use of your account
  • You will not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorisation, or a name that is otherwise offensive, vulgar or obscene

We reserve the right io suspend or terminate your account if you are using our Site illegally or if you violate these Terms.

 

Membership Fees

Billing and Renewal
Membership of the PAA is billed annually, with renewal on the first day of the month closest to your join date.

Cancellation
You can membership at any time by emailing us at info@pilates.org.au. Your cancellation will take effect at the end of the current paid term.

Fee Changes
We may, from time to time, make changes to the membership fee and we will communicate any price changes to you in accordance with applicable law

 

Third Party Sites

Our Site contains links to third party websites and services that are not owned or controlled by the PAA. The PAA has no control over, and assumes no responsibility for the content, privacy policies or practices of any third-party websites or services.

We advise you to read the terms and conditions, and privacy policies of any third-party websites or services that you access from the Site.

 

Limitation of Liability

The PAA and our committee, employees, and agents will not be liable for any actions, claims, losses, damages, liabilities and/or expenses including legal fees from your use of the Site.

Except where prohibited by law, by using this Site you indemnify and hold blameless the PAA and our committee, employees, and agents from any actions, claims, losses, damages, liabilities and/expenses including legal fees from your use of the Site or your violation of these Terms.

 

Laws Governing the Terms of Use

These Terms shall be governed by and defined following the laws of the State of New South Wales and Australia. The PAA acknowledges that the Site may be accessed internationally and does not make any representation that the Site complies with any overseas laws.

 

Complaint Procedure and Customer Service

If you have any concern or dispute about the Site, you agree first to try to resolve the dispute informally by contacting the PAA. If you and the PAA are unable to resolve any dispute informally then you and the PAA agree to submit the issue before a non-binding mediator, and to an arbitrator if that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and the PAA.
