Resubmission of the PAA Constitution

To all members of the PAA

At our last Annual General Meeting we announced that the PAA had received notification from the Department of Fair Trading (NSW) of a number of changes to the Associations Incorporation Act of 2009, now to be known as the Associations Incorporation Regulation 2016.

They advised that for one year from 1 September 2016, any association wishing to update its constitution as a result of the amendments to the legislation will not have to pay a fee to register the change. Therefore, we have until 1 September 2017 to lodge our updated constitution at no charge to the association.

Based on this information, it was decided by the committee and then flagged at the AGM (18 November 2016), that this was a great opportunity to update and revise our current constitution whilst amending any identified ambiguities or inconsistencies that may be contained in the document.

I would urge all our members to review the current PAA constitution located on the Pilates Alliance website (PAA Constitution) and if you can identify any such inconsistencies, omissions, ambiguities or unnecessary clauses contained within the document, then please communicate your concerns/suggestions to me, the PAA Secretary (mary@pilates.org.au), before 30 June 2017.

Any proposed change must
• clearly state which section, clause and subclause that the change applies to
• use clear, concise and unambiguous language to suggest the amendment

Once the working constitutional sub-committee has collated and appropriately worded any proposed changes or additions, the full membership of the PAA will be invited to vote as to whether they approve, or otherwise, of these proposed changes. For changes to be made, 75% of those who vote for each clause will need to be in favour. If that figure is not reached then the clause will remain as it is currently worded.

As it is no longer necessary to hold a special general meeting for these changes to be voted on, it is our intention to use a postal or electronic voting system. Under the new schedule this is now an approved manner of carrying out a vote.

Voting will occur in August to allow sufficient time to insert any changes necessary before lodging the revised constitution with the NSW Department of Fair Trading by 1 September 2017.
